HR-420 Medical Resident Leaves

Summary

The 九色视频 (University) employs Residents who are enrolled in American Board of Medical Specialty (ABMS) specialty and sub-specialty Residency Programs at 九色视频 Health Care (MUHC) and 九色视频 鈥 Kansas City School of Medicine (UMKC SOM). The University supports providing Residents with time away from training for personal and familial needs while also ensuring that Residents are able to meet the training requirements to become eligible for Initial Certification from the applicable ABMS Board.

Nothing in this Policy shall be deemed to create any additional leave rights for Eligible Residents other than as specifically stated in this Policy or pursuant to other applicable University Policies.

If any part of this Policy does not reflect with the Collected Rules and Regulations (CRR) set forth at /ums/rules/collected_rules , the provisions of the CRR will govern.


HR Policy Provisions

  1. Purpose
    This Policy describes the University鈥檚 commitment to complying with the ABMS Policy, 鈥淧arental, Caregiver and Medical Leave During Training鈥 and the ACGME Institutional Requirements.
  2. Eligibility
    1. Eligible Resident - A Resident physician employed by the 九色视频 enrolled in an Accreditation Council for Graduate Medical Education (ACGME) approved or unapproved Residency Program of at least 2 years at MUHC or UMKC SOM, including Intern, Resident, and Fellow.
    2. Not Eligible - Individuals employed by the University in other residency programs including, but not limited to, research, veterinary, dentistry, physician assistant, anesthesia assistant, or pharmacy residency programs.
  3. Medical, Parental, and Caregiver
    1. Definitions
      1. Medical, Parental, and Caregiver Leave is defined in Policy HR-407, Family and Medical Leave Act (FMLA), Section D.1.a-c.
      2. Serious health condition: as defined in Policy HR-407, FMLA, Section C.
    2. Leave Available
      1. Eligible Residents who are eligible under HR Policy 407, FMLA, are entitled to receive the benefits under that Policy in accordance with its terms.
      2. Eligible Residents who are not eligible under HR Policy 407, FMLA, shall be permitted at least six (6) weeks of time off from their Residency Program, or longer if required by the applicable ABMS Board for that Residency Program, at least one (1) time during their Residency Program for approved parental, caregiver, and medical leaves. These leaves will be handled consistent with the provisions and process set forth in HR Policy 408, Leaves of Absence.
    3. Compensation
      1. Residents approved for leave accordance with this Section III shall receive 100 percent of their base salary for the first six (6) weeks of an approved Medical, Parental, and Caregiver leave of absence one time during the Residency Program.
      2. The following order will be submitted to provide paid leave:
        a. Available balance of paid annual leave per CRR 320.070.
        b. Once all annual leave is exhausted, the remaining leave shall be approved as a paid leave of absence.
  4. Vacation Leave
    1. Leave Available - Eligible Residents shall be permitted at least two (2) weeks of time off from their Residency Program at least one time during their Residency Program for vacation or other personal reasons.
    2. Compensation
      1. Residents approved for leave in accordance with this Section IV shall receive 100 percent of their base salary for the first week of approved vacation leave.
      2. The following order will be submitted to compensate for approved leave:
        a. Available balance of paid annual leave per CRR 320.070.
        b. Once all annual leave is exhausted, the remaining leave for the first week shall be approved as a paid leave of absence. The remaining leave for the second week shall be approved as an unpaid leave of absence.
  5. Other Provisions
    1. Any approved leave may be taken intermittently.
    2. A week is defined as 5 days or 40 hours.
    3. Leaves of absence may delay the completion of a Residency Program.
